These Terms of Service (“Terms”) govern your access to and use of notappropriatehumor.com and any related sites, apps, accounts, or services that link to these Terms (the “Site”). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Who We Are

Not Appropriate Humor (“Not Appropriate Humor,” “we,” “us,” or “our”) operates the Site and sells products and services through it.

2. Eligibility and Accounts

• Minimum age: You must be at least 13 to use the Site. To make a purchase, you must be 18 or older (or have parental/guardian consent).
• Account information: Keep your account credentials confidential and your information accurate and up to date. You are responsible for all activity under your account.
• Suspension: We may suspend or terminate your account or access to the Site for suspected fraud, policy violations, or unlawful conduct.

3. Orders, Pricing, and Availability

• Offer and acceptance: Your order is an offer to buy. We may accept or reject any order, in whole or in part, including for availability, errors, or suspected fraud. We will issue a refund for any rejected portion.
• Product information: We try to be accurate, but errors may occur (e.g., price, description, availability). We may correct errors and cancel orders that have not shipped. If we cancel, we will refund you.
• Taxes and fees: Prices exclude taxes, duties, and shipping unless stated. You are responsible for applicable taxes and shipping. We may collect taxes where required by law.
• Promotions: Discounts and promotions are subject to their terms and may be modified or withdrawn at any time.
• Gift cards/store credit: Nonrefundable except as required by law; lost or stolen cards will not be replaced.

• Methods: We accept the payment methods displayed at checkout and process payments through third-party processors. We do not store full payment card numbers.
• Authorization: By submitting a payment method, you represent you are authorized to use it and authorize us (and our processors) to charge the full order amount, including taxes, shipping, and any recurring charges you agree to.
• Chargebacks: We reserve the right to dispute chargebacks and to suspend or cancel orders and accounts associated with fraudulent disputes.

5. Shipping, Risk of Loss, and Title

• Shipping: We ship to the destinations shown at checkout. Shipping estimates are not guaranteed.
• Risk of loss: Risk of loss passes to you when the order is delivered to the carrier. Title passes upon delivery to your address.
• Delivery issues: Report missing, damaged, or incorrect items promptly to support@notappropriatehumor.com.

6. Returns and Refunds

Your purchase is subject to our Return and Refund Policy, available at https://www.notappropriatehumor.com/returns. That policy is incorporated into these Terms.

7. Subscriptions and Auto-Renewals (if applicable)

If you enroll in any subscription, it will auto-renew at the then-current price and billing interval until you cancel. We will disclose key terms at sign-up. You can cancel at any time effective at the end of the current term through your account or by emailing support@notappropriatehumor.com. We will provide any legally required pre-renewal notices.

8. Your Content and Feedback

• Your content: If you post, upload, or submit reviews, comments, photos, or other content (“User Content”), you grant Not Appropriate Humor a worldwide, nonexclusive, royalty-free, transferable, sublicensable license to host, use, reproduce, distribute, display, perform, modify, and create derivative works from your User Content in connection with operating, promoting, and improving the Site and our products and services.
• Rights and responsibilities: You represent that you own or have the rights to submit your User Content and that it does not infringe, violate, or misappropriate any third-party rights or laws. Do not post anything unlawful, misleading, obscene, defamatory, or that contains personal information of others without consent.
• No confidentiality: We have no obligation to keep User Content confidential. Do not submit confidential information to us through public features of the Site.
• Feedback: If you send us ideas, suggestions, or improvement requests (“Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use the Feedback without restriction or compensation.

9. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or to violate any laws or regulations
• Infringe or violate intellectual property or other rights
• Interfere with or disrupt the Site, servers, or networks, or bypass security measures
• Upload malware, perform scraping or automated harvesting without our permission, or attempt to reverse engineer the Site

• Collect personal information of other users without consent

The Site, including its text, graphics, logos, product images, videos, software, and other content (“Site Content”), is owned by Not Appropriate Humor or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for your personal, noncommercial use. Any other use is prohibited without our prior written consent.

11. DMCA and Copyright Policy

We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a notice containing the information required by 17 U.S.C. § 512(c)(3) to our designated agent:

Upon receiving a valid notice, we may remove or disable access to the content and, where appropriate, terminate repeat infringers. Submitting false claims may result in liability.

• Not Appropriate Humor and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, data, or goodwill, arising out of or related to these Terms or your use of the Site.
• Our total liability for all claims arising out of or related to these Terms or the Site will not exceed the greater of (a) the amount you paid to us for the product or service at issue in the 12 months before the event giving rise to the claim, or (b) $100.
• These limits apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations; those limitations may not apply to you to the extent prohibited by law.

You will defend, indemnify, and hold harmless Not Appropriate Humor and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms or applicable law; or (c) your User Content or your infringement, violation, or misappropriation of any rights of another party.

17. Changes to the Site and to These Terms

We may modify or discontinue any part of the Site at any time. We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the effective date. Your continued use of the Site after changes means you accept the updated Terms.

18. Termination

You may stop using the Site at any time. We may suspend or terminate your access (and delete your account) for any reason, including if you violate these Terms or applicable law. Sections that by their nature should survive termination will survive (including ownership, disclaimers, limitations of liability, and dispute resolution).

19. Governing Law; Venue; Waivers

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of laws rules. You agree that the state and federal courts located in Crow Wing County, Minnesota will have exclusive jurisdiction and venue for disputes arising out of or relating to these Terms or the Site, and you consent to their jurisdiction.

To the fullest extent permitted by law: (a) you and we waive any right to a jury trial, and (b) disputes will be brought only in your or our individual capacity and not as a class, collective, or representative action. If the class action waiver is found unenforceable as to a particular claim, that claim must be severed and brought in court.

20. Export and Sanctions

You may not use the Site or purchase products if you are located in, or are a resident or national of, a country or region subject to comprehensive U.S. sanctions, or if you are on a U.S. government restricted party list. You agree to comply with U.S. export control and sanctions laws.

• No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
• Severability: If any provision is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be replaced with an enforceable one that comes closest to the original intent.
